Exactly. Justice Moreno wrote in his dissenting opinion that Prop. 8 was an unlawful change to the CA Constitution because of its very nature. I get the court's logic in upholding Prop. 8, but it's not like they couldn't have argued just as logically and effectively for striking down Prop 8.
